Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of the amount you paid, if any, to Summit Seeker Adventures for use of the Service during the six (6) months preceding the claim, or $100.

7. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the State of Everview, within the jurisdiction of the Evergreen City Courts, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal or state courts located in Evergreen City and you hereby consent to the personal jurisdiction of such courts.
